An attorney’s advice for getting rid of a foreclosure case: don’t do it.
A lawyer who specializes in property-related litigation, James Hoch, says it’s important to be clear about the purpose of the lawsuit.
You’re asking the court to find the property owner has a debt that is in default, and you’re trying to make a claim about a debt you’ve already paid, he says.
If you’ve paid your mortgage and you’ve made some progress in closing the case, the court might not consider that evidence in deciding whether to dismiss the case.
So, before you go to court to seek a foreclosure, talk to your attorney to see if you have any other legal options that could have been used in the case that might be able to be considered.
In the end, Hoch says, the attorney will give you the best advice for what to do if you’re sued in a mortgage foreclosure lawsuit.
